Terms of Service

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement and that you have the legal capacity to enter into a binding contract.

You are responsible for:

• providing accurate registration information and keeping it up to date;
• maintaining the confidentiality of your credentials and any device on which you remain signed in;
• all activity that occurs under your account.

Notify us immediately at support@4siempre.com if you suspect unauthorized access to your account.

Siempre is a private social timeline product that lets users create shared timelines with chosen Members, post memories (text, photo, video, voice, location, links, music), import message history from third-party services such as WhatsApp, plan and remind using built-in tools, and interact with our AI assistant ("Sussy"). We may also offer physical jewelry products that link to digital timelines via QR codes.

We may add, change, suspend, or remove features at any time. We may impose usage limits and adjust them as needed.

4.1 Free and paid tiers

The Service offers a free tier and one or more paid tiers (such as Siempre Pro) and physical product purchases. Pricing and features are described in the app or at 4siempre.com and may change. Material price changes will be communicated to you in advance.

4.2 Subscription billing

Paid subscriptions are billed in advance and automatically renew unless cancelled before the end of the current billing period. Cancel through your app store account or, where applicable, your account settings. Cancellation takes effect at the end of the current paid period. Except where required by law, we do not provide refunds for partial billing periods.

4.3 Jewelry and physical products

Jewelry orders are charged at the time of purchase. Shipping, returns, and warranty terms are described at the point of sale and supplement these Terms. Custom or personalized items may be non-returnable except in case of defect.

4.4 Taxes

Prices may not include taxes. You are responsible for any applicable taxes, duties, or similar charges, except those based on Siempre's net income.

4.5 App Store purchases

Purchases made through the Apple App Store or Google Play are also governed by the applicable store's terms. Refunds for app store purchases are handled by the store, not by Siempre.

5.1 Ownership

You retain all rights you have in the content you create, upload, import, or share through the Service ("Your Content"). These Terms do not transfer ownership of Your Content to Siempre.

5.2 License to Siempre

To operate the Service, you grant Siempre a worldwide, non-exclusive, royalty-free license to host, store, transmit, transcribe, transcode, reformat, display, and otherwise process Your Content solely as needed to provide the Service to you and the Members you share it with. This license ends when you delete Your Content or your account, except for content already shared with other Members and except as needed for backups, fraud prevention, or legal compliance.

5.3 Your responsibilities

You are responsible for Your Content. You represent and warrant that:

• you own Your Content or have all rights necessary to upload and share it;
• Your Content does not infringe any third party's intellectual property, privacy, publicity, or other rights;
• when you import messages or media from services such as WhatsApp, you have the right to import that content and have considered the privacy expectations of the other people in those conversations;
• when you upload media containing other people's voice or image, you have any consents required by applicable law;
• when you add another person as a Member, you have a reasonable basis to believe they will welcome the invitation.

5.4 Removal

We may remove Your Content if we believe it violates these Terms, our policies, or applicable law, or if it poses a risk to Siempre or our users.

You agree not to:

• use the Service to harass, threaten, defame, impersonate, or stalk any person;
• upload or share content that is unlawful, infringing, sexually exploitative of minors, depicts non-consensual intimate imagery, or promotes violence, self-harm, or terrorism;
• upload or share another person's private communications, identifying information, or personal data without a lawful basis;
• attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
• reverse engineer, decompile, or disassemble any part of the Service, except to the extent permitted by applicable law;
• interfere with or disrupt the Service, including by transmitting malware, sending excessive requests, or scraping data at scale;
• use the Service to build a competing product, train AI models on user content you do not own, or otherwise extract content beyond personal use;
• use bots or automated tools except via interfaces and rate limits we expressly authorize;
• misuse the Sussy assistant by attempting to bypass safety controls, generate prohibited content, or extract underlying prompts or model weights;
• circumvent any access controls, billing systems, or usage limits.

We may suspend or terminate accounts that violate these rules.

Sussy is an AI assistant that uses third-party large language models, including the Anthropic Claude API, to generate responses based on context drawn from your account when you invoke it. You acknowledge that:

• AI responses can be inaccurate, incomplete, or out of date and should not be relied on for legal, medical, financial, or other professional advice;
• Sussy may misinterpret context, make up facts, or produce content you disagree with — review outputs before acting on them;
• when you invoke Sussy, the relevant context is sent to our AI provider for processing as described in our Privacy Policy;
• you must not use Sussy to generate content that violates Section 6 or our AI provider's acceptable-use policies.

When you record a voice note, the audio is uploaded to our cloud and may be transcribed to text using a third-party transcription service. Transcripts are best-effort and may contain errors. You should not use voice notes to communicate information that requires guaranteed accuracy without independent confirmation.

The WhatsApp import feature allows you to upload an export archive containing your conversations and process them into Siempre memories. You are responsible for ensuring you have the right to import that content. Other participants in the original conversation may not have agreed to have those messages imported into Siempre — use the feature thoughtfully.

Content you post to a shared timeline is visible to every Member of that timeline. Members may, depending on their role, comment, react, save, or remove content. Removing yourself from a timeline does not delete content you previously posted; the timeline owner controls retention. We are not responsible for what other Members do with content you share.

Our Privacy Policy describes how we collect, use, and share information. By using the Service, you agree to the Privacy Policy.

The Service, including its software, design, branding, and the "Siempre" and "4siempre" names and logos, is owned by Siempre or its licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved. You may not use our trademarks without our prior written consent.

If you send us feedback, suggestions, or ideas about the Service, you grant us a royalty-free, perpetual, worldwide license to use them without restriction or compensation.

You may stop using the Service at any time and delete your account from within the app or by contacting support@4siempre.com.

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if your account has been inactive for an extended period, if continuing to provide the Service to you would expose Siempre to legal or security risk, or if we cease operating the Service.

On termination, your license to use the Service ends. Sections that by their nature should survive termination will survive.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIEMPRE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; THAT DEFECTS WILL BE CORRECTED; OR THAT CONTENT WILL BE ACCURATE OR RELIABLE. WE DO NOT WARRANT ANY OUTPUT GENERATED BY SUSSY OR ANY THIRD-PARTY AI MODEL.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SIEMPRE AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold harmless Siempre and its officers, members, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to (a) Your Content; (b) your use of the Service; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Subject to the arbitration provision below where applicable, you and Siempre agree to the exclusive jurisdiction of the state and federal courts located in Suffolk County, Massachusetts for any disputes not subject to arbitration.

We may update these Terms from time to time. If we make material changes, we will notify you through the app, by email, or by other reasonable means before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

• Entire agreement. These Terms, together with our Privacy Policy and any product-specific terms, constitute the entire agreement between you and Siempre regarding the Service.
• Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
• No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
• Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of assets.
• No agency. No agency, partnership, or joint venture is created by these Terms.
• Apple-specific terms. If you use the iOS app, these Terms are between you and Siempre, not Apple. Apple is a third-party beneficiary of these Terms with respect to the iOS app.
